Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TableSeer platform, website, dashboard, and related services (the “Service”) provided by [Your Legal Entity Name](“TableSeer,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Overview of the Service
TableSeer provides reservation management and messaging automation tools designed for restaurants, including reservations initiated through WhatsApp.
The Service enables restaurants to receive reservation requests, send confirmations and reminders, and manage bookings through a web-based dashboard.
2. Eligibility
To use the Service as a restaurant customer, you must be at least 18 years old and authorized to act on behalf of a business entity.
Diners interacting with restaurants via WhatsApp do not establish a direct contractual relationship with TableSeer by sending messages.
3. Restaurant Responsibilities
Restaurants using TableSeer agree to:
- Provide accurate business and account information
- Maintain the confidentiality of login credentials
- Ensure reservation availability is properly managed
- Comply with all applicable Colombian laws and regulations
- Provide diners with appropriate privacy notices and reservation terms
- Obtain any necessary consents for WhatsApp communications and personal data processing
Restaurants remain solely responsible for their services, reservation policies, cancellations, and customer interactions.
4. WhatsApp and Third-Party Messaging Platforms
TableSeer integrates with WhatsApp and other third-party communication platforms to provide messaging functionality.
Use of WhatsApp is subject to WhatsApp’s own terms, policies, and service availability. TableSeer is not responsible for interruptions, policy changes, delivery failures, or restrictions imposed by WhatsApp or other providers.
5. Data Protection and Colombian Privacy Compliance
TableSeer processes personal data in accordance with applicable Colombian data protection laws, including Law 1581 of 2012 and related regulations.
For diner reservation data, the restaurant is generally considered the primary data controller (“Responsable del Tratamiento”), while TableSeer acts as a data processor (“Encargado del Tratamiento”) providing the Service.
Restaurants are responsible for ensuring they have appropriate legal authorization to collect and use diner data.
6. Fees and Subscription Terms
Certain features of the Service may require payment of subscription fees. Pricing and billing terms will be provided at signup or purchase.
Unless otherwise required by law, fees are non-refundable.
7. Acceptable Use
You agree not to misuse the Service, including by:
- Using the Service for unlawful purposes
- Sending spam or unauthorized marketing messages
- Attempting to disrupt platform security or infrastructure
- Copying, reselling, or reverse engineering the Service
8. Intellectual Property
TableSeer retains all rights, title, and interest in the Service, software, trademarks, branding, and technology.
Restaurants retain ownership of their reservation and customer data.
9. Termination
TableSeer may suspend or terminate access if these Terms are violated or if required by law.
Restaurants may cancel their subscription according to billing terms.
10. Disclaimers
The Service is provided “as is” and “as available.” TableSeer makes no warranties that the Service will be uninterrupted, error-free, or perfectly reliable.
11. Limitation of Liability
To the maximum extent permitted under Colombian law, TableSeer shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption.
TableSeer’s total liability shall not exceed the amount paid by the restaurant in the twelve (12) months preceding the claim.
12. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of Colombia. Any disputes shall be subject to the jurisdiction of the courts of [Bogotá D.C., Colombia], unless otherwise required by law.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after updates become effective constitutes acceptance of the revised Terms.
